In the part 2 of trying to define indigenous people and the last episode of Season 2, Tiemo and Aljaz take a look at the definitions brought forward by the African Commission and the African Court of Human Rights. With these two definitions, several difference are observed and Tiemo and Aljaz try to explain reasons behind that. At the end, they offer the reflections on this two part episode and state general comments on the whole situation of being indigenous people and the controversies which have arisen from that. In the last segment of Season 2 of Juristudents, Tiemo and Aljaz discuss another extensive topic in a two part episode - how the term indigenous peoples is defined by the American Court of Human Rights and the African Court of Human Rights. In this first part, Tiemo and Aljaz will look at how the American court handles the definition, what are the issues with it and how can it be improved. They discover that indigenous rights were created to protect an especially vulnerable group in society; however, for them to work, we need a definition of “indigenous” - this can be very tricky. Aljaz and Tiemo are both encouraging everyone to get in touch with their definitions.

This is the second part to the trip to East Asia by Tiemo and Aljaz as they continue the explore the similarities, differences and controversies of the Chinese and the Singaporean international commercial courts. In this part the conversation focuses on the inetrnationality of the courts, more specifically, which language is used as the language of the proceedings, who are the judges and who are the lawyers which lead them to make very interesting conclusions about how these courts do the same area of dispute resolution very differently. They try to find reasons behind certain decisions and offer their general reflections on what was discussed over this two part episode. Thank you for listening!

In this episode, Tiemo and Aljaz virtually travel to east Asia to compare the new China International Commercial Court to the established Singapore International Commercial Court. There are various procedural and substantive differences to the courts starting with the political reasons behind their establishment. Also in this episode, they discuss the jurisdictional aspects about what kinds of cases can be brought before each court. Naturally, the conversation expands also to a more general discussion on the Chinese Belt and Road Initiative (BRI) and what this may mean for the future of international commercial dispute resolution. The research for this topic was so extensive, the episode had to be split into two episodes and the second part will be published shortly. Tiemo and Aljaž record one of the most difficult episodes yet. They have a conversation on what is happening currently and why in Israel and surrounding territories. They provide a brief history of Israel and Palestine and discuss legal terms such as self defense, necessity, proportionality and distinction. After, they have a conversation trying to present all sides to this incredibly complex issue and ponder about possible solutions, what ifs and whens. Tiemo and Aljaž realize this is an incredibly emotional topic for many people and there are extreme views on both sides. With this episode, Juristudents is not taking a stand for any side and simply wants to bring back something so often missing in our lives - conversation about difficult issues. Tiemo and Aljaž are joined by a special guest Maja to guide them on a path exploring conflict minerals in the Democratic Republic of Congo (DRC). The mineral mostly discussed in this episode and dominant in the DRC is cobalt. These cobalt mines are problematic as they may involve child labor and other human rights abuses. The trio explore what the EU has been doing to mitigate the situation, namely the Conflict Minerals Regulation and expand to a broader discussion on the solution for human rights abuses in mineral mines. The discussion goes beyond the DRC to Africa in general where issues of corruption are rampant and external actors such as Russia and China are stirring the pot making it difficult to prevent human rights exploitation in these mines.

Guilty - the verdict for the infamous police officer Derek Chauvin for the killing of George Floyd. To present a full picture, Tiemo and Aljaž make a follow up episode discussing the verdict by the jury in this highly publicized trial. They touch upon appeals and sentencing, as well as what lies ahead for Chauvin, Chauvin's police team, the Minneapolis Police Department, and Floyd's family. 

Together at last - Tiemo and Aljaž record an episode face to face for the first time in Season 2. To mark this occasion, they embark on a journey of one of the most controversial and publicized trials in American history, namely the current Derek Chauvin trial. Mr. Chauvin is the infamous police officer who killed George Floyd last year sparking mass protests across the USA. Tiemo and Aljaž discuss the charges and arguments relevant in the trial, as well as offer their thoughts on more general aspects of trials such as juries, powers of the judge and comparisons to European systems. Corruption, more specifically, bribery is dominant in business transactions all around the world. Aljaž and Tiemo explore the notion of corruption and why it is so relevant in the international context. They define the curious cultural background of corruption via psychological phenomena, as well as tradition - such as Chinese guanxi. This leads to a general discussion about what is being done to prevent bribery, for example work by the OECD, and why corruption seems to be a flaw in the governing systems that is so difficult to eradicate. Both are excited and intrigued to hear your opinions on the topic.

The voyage in Season 2 continues for Tiemo and Aljaz with a very special episode, namely a guest episode. A special guest, Sabrina Nucciotti, comes on to talk about a very topical area of mental health, more specifically, the legal aspects surrounding this incredibly diverse sector. The three musketeers talk about, specifically, mental health law in Scotland with the current mental health act being under review and eventually branch out into a more general discussion and even some arguments on capacity, consent, medical paternalism and even the coronavirus vaccines.
