He follows the case law from Calder v. Bull in 1798 through Dred Scott, the Black Codes, the Slaughter-House Cases, Colfax, and Cruikshank, to Heller, McDonald, and Bruen. Scott argues the Declaration asks one question of every gun law: by what authority?KEY QUESTIONS ADDRESSEDWhere do our rights come from according to the Declaration of Independence, and how did courts separate it from the Constitution? What did the Slaughter-House Cases and Cruikshank decide about federal protection of the right to bear arms? What do DeShaney and Castle Rock say about police protection, and why does Scott say that matters for the Second Amendment?ABOUT BARDSFMBardsFM is a daily independent podcast covering faith, liberty, history, and information warfare.
