He was hanged the day after a fire he had nothing to do with.WHAT THIS EPISODE COVERS Scott Kesterson and Rochelle Porto open with a foundational argument: the colonists fought for the Declaration of Independence, not a Constitution that didn't exist yet, because their rights came from God rather than a king, a distinction Scott ties directly to a real FBI raid that listed a copy of the Declaration as a suspicious document. The two then chronicle the fall of 1776 across two fronts — the Southern Cherokee-Loyalist theater at Kaiicho River and Long Island, where nearly 2,000 Cherokee died in a British-backed campaign that ultimately failed, and the Northern theater's Battle of White Plains, where Washington escaped William Howe's larger force before Fort Washington and Fort Lee fell by early November. Along the way they cover Nathan Hale's execution, General Charles Lee's suspected communications with the British, and Benedict Arnold's 1780 defection letter accusing Congress of prolonging the war for its own ambition — closing on a prayer of morning sacrifice attributed to George Washington.KEY QUESTIONS ADDRESSED Why does Scott argue the colonists were fighting for the Declaration of Independence rather than a Constitution that didn't yet exist — and what does an FBI raid confiscating a copy of the Declaration as a "suspicious document" reveal about why that distinction still matters? What happened in the Southern Cherokee-Loyalist theater in the fall of 1776 — and why did a British-backed campaign that cost nearly 2,000 Cherokee lives and destroyed half of 62 towns fail to meaningfully divert the American war effort in the North? What evidence exists that General Charles Lee, Washington's second-in-command, was communicating with the British during his 1776 captivity — and why does Scott connect that same era's fight over mercantilism and controlled trade to the Patriot Act and the modern surveillance state?ABOUT BARDSFMBardsFM is a daily independent podcast covering faith, liberty, history, and information warfare.
