Summary
These days the idea of tribal sovereignty is having a rough patch, at least iin the body politic. The Senate is considering legislation that would roll back the gains in recent years of tribal court jurisdiction concerning the Violence Against Women Act. And a federal appeals court is reconsidering the fundamental nature of the Indian Child Welfare Act.
So it’s big news when a tribe has a clear victory … based on its inherent sovereignty.
A three-judge panel for the U.S. 9th circuit court of appeals agreed in a decision released Nov. 15, 2019, It said that the tribes have jurisdiction over the company. “We hold that the judgment of the Tribal Court of Appeals is enforceable.”
