America is not a democracy. The founders studied democracy carefully, rejected it outright, and built something else entirely — and most Americans cannot name what it is. In this third lesson of the Constitution and first principles training series, Jenny Beth Martin sits down with constitutional scholar Bill Norton to answer the question almost nobody can finish: if we are not a democracy, then what exactly are we?
Norton skips the checks-and-balances lecture everyone got in civics class and rebuilds the Constitution from the founders' own blueprint. He walks through the five basic forms of government — anarchy, monarchy, oligarchy, democracy, and the republic — and shows why Brazil, Russia, India, China, and South Africa can all call themselves republics while looking nothing like America. He explains why anarchy always collapses into dictatorship and why democracy always collapses into rule by a select few, which is exactly why the elitists who promote democracy know what they are doing.
Then comes the framework that makes the whole machine legible: a republic is rule by balance. Norton maps which form of government the founders deliberately placed inside each branch, why the Seventeenth Amendment broke the Senate in 1913, why Supreme Court justices are not appointed for life, and how Marbury versus Madison handed the courts a power the Constitution never granted. Along the way, the story of Elizabeth Powell — the woman who actually asked Benjamin Franklin what he had given us.
Bill Norton is a constitutional scholar, coauthor of Speaking the Language of Liberty, and author of the forthcoming Behind the Constitution.
