What makes the administrative state morally legitimate in a constitutional republic?


Supporters argue that administrative law has developed its own internal morality, constraining and legitimizing administrative power. But opponents claim that the administrative state has exceeded its constitutional bounds and is a threat to the common good that needs to be reined in by Congress and the courts.
