In this special episode of Law Brief, Rich Schoenstein and his partner David Kleinmann discuss the Workforce Mobility Act, a new bill introduced in Congress that would ban the use of non-competes to restrain workers from taking new jobs. Rich and David — both members of Tarter Krinsky & Drogin’s Restrictive Covenant Practice Group — survey the existing judicial landscape in this area and argue that the overreaching bill fails to make important distinctions that should be considered in evaluating restrictive covenants.
