In this episode, 340B Report Publisher and CEO Ted Slafsky joins Associate Editors and Senior Writers Shannon Young and Will Newton and National Correspondent Luke Zarzecki in breaking down the latest in 340B news, including: Eli Lilly's 340B in-house claims data threat and a leading provider law firm's response; high-stakes oral arguments over two states' contract pharmacy laws; and the results from primaries involving high-profile 340B advocates. The team also recaps 340B Report's recent webinar on key 340B legal issues.
Key Topics Covered:
Lilly's In-House Claims Data Ultimatum
Luke highlights two recent letters sent to the Health Resources and Services Administration: one from Lilly and one from Hall Render, a law firm representing 340B providers. Lilly notified covered entities they had five days to comply with its 340B in-house pharmacy claims data submission policy, while Hall Render called for a U.S. Department of Health and Human Services Inspector General investigation into Lilly's requirements. Shannon notes that Sanofi recently announced 340B in-house claims data requirements, making it the ninth drugmaker to do so.
Latest Primary Results
Shannon breaks down early results from June primary contests in California and South Dakota. She notes that U.S. Rep. Doris Matsui (D-Calif.), who is seen as a key 340B provider advocate in Congress, placed first in her primary. But, Shannon adds, she is likely to once again face off against a tough Democratic challenger, Mai Vang, in November. Shannon also discusses U.S. Rep. Dusty Johnson's (R-S.D.) third place finish in South Dakota's GOP gubernatorial primary, and how the loss of another key 340B leader on Capitol Hill could shape 340B policymaking in the next Congress.
Oral Arguments and 340B Report Webinar
Will discusses recent oral arguments on drugmaker challenges to Maine and Rhode Island's 340B contract pharmacy access laws before a Boston federal appeals court. He notes that one of the judges last year was a partner at a law firm where other partners were lobbying for a drug industry trade group against Maine's contract pharmacy bill before it became law. Will, Luke and Ted then break down the biggest takeaways from 340B Report's recent subscriber-only webinar, where two attorneys representing the covered entity and manufacturer perspectives joined 340B Report's editorial team to discuss the biggest 340B legal developments.
