The jury came back after nearly 38 hours of deliberations with a note that said “with a heavy heart”  we are unable to come to a unanimous decision. After protest from the defense, Judge Sullivan said he had no choice but to declare a mistrial. But that didn’t stop Kevin Reddington who asked to appeal to a Supreme Court Justice to issue an emergency stay on the ruling, and shockingly, Judge Sullivan gave him one hour.
